Fishers set for fines for illegal fishing methods

NSW Department of Primary Industries (DPI) Fisheries Officers have apprehended a number of illegal fishers during the opening days of the Murray cod season, DPI Director of Compliance, Glenn Tritton, said today.

A three month ban on taking or attempting to take Murray cod is in place each year from September to November inclusive to protect the important native species during its breeding season.

“Fisheries officers were out in force in the Riverina region, targeting fishers illegally catching the iconic species during the first few days of the opening season,” Mr Tritton said.

“In five separate incidents on the Wakool and Murrumbidgee Rivers, five individuals were caught by fisheries officers in possession of illegal fishing gear.

“Fisheries officers seized a total of 31 setlines and three Murray Cod which were taken the day prior to Murray Cod Season opening.”

“Setlines can no longer be used in any inland waters and are totally prohibited.

“Setlines are baited hooks on lines that are attached to trees or snags along the waters edge, where many native fish seek refuge, and can have devastating consequences on our native fish populations.

“This method of fishing is viewed as archaic and was banned in NSW to reduce the high level of destruction that was being inflicted on target and non target species.”

Two attended lines may be used in all inland waters (except some trout waters and closed waters) and these lines must be within 50 metres and in your line of sight.

Live finfish including carp, birds and mammals cannot be used as bait.

There is a daily bag limit of two Murray cod per person per day and a total possession limit of four when fishing in any inland waters.

The minimum legal length of Murray cod is 60 cm, however fishers may only retain one over 100 cm

The illegal fishers face charges of possess prohibited fishing gear with a maximum penalty of $22,000 or imprisonment for 6 months (or both) for a first offence,using more than two hand held lines in inland waters with a maximum penalty of $11,000, leave hand held line unattended in inland waters which comes with a maximum penalty of $5,500 and take declared fish which comes with a maximum Penalty off $22,000 and/or imprisonment for 6 months for a first offence.

Each individual will be issued with a number of penalty notices with a maximum penalty of $500.

“We continue to ask for the public’s help in the fight to stop illegal fishing in our waterways.” Mr Tritton said.

Just goes to show how important it is to regularly review each states regulations. I was not aware that it is illegal to use set lines in NSW, I havent used one for nearly 60 years when we used to use them in the Dawson at Taroom.

Meanwhile in Queensland FARTSAQ, who claim to represent all freshwater fishing, offer support to set lines the banjos will play long and loud.

This permit authorises the holder to take freshwater fish fromany or all the stocked impoundments listed in the Fisheries, by using a fishing line or set line. This permitRegulation 2008is non--transferable.
Maybe we will get a chance to change the regs when the review comes out.
