Correct. If the tide moves there, the closed season applies. So above any weir, rock bar that blocks the tide or above that first set of rapids that the tide doesn't get over the closed season doesn not apply.

So in Brisbane River the boundary would be the old Mt Crosby Weir,
Bremer River it would be around the Jim Finmore Sportsground, or the One Mile Bridge to be sure for larger tides,
Albert River would be the causeway on Stanmore Rd,
Caboolture River would be the weir,
Nerang River would be the causeway at Nerang I reckon....
Logan River, god only knows...

It is still a bit iffy.
I have written to DAD and their writtenanswer was if there is movement on king tides the waters were deemed tidal and when I particularly asked again about Stanmore Road I got a phone call back and was told that the boundary is Stanmore crossing even though the water above the road rises and falls even on a medium tide.
At a BCF club meeting last month the fisheries officer said that they have a rule of thumb if there are mangroves present its tidal and if no mangroves its open season.
My take is plenty of other places that are not borderline to fish.
 Cheers
Ray

On that basis you can fish any fancy housing address where the mangroves magically disappeared late one night  ;D

It is all pretty academic, if your a dodgy bugger, little chance of you getting caught, the only thing that truly enforces fishing regs in Qld is ones own level of guilt!

There's no mangroves on the Bremer River anywhere at all, but it's deifnately tidal.

Maybe the person you spoke to Ray, was referring to the level if interest from their staff when the mangroves stop?  :Oops)

Try googling Qld Tidal Water Limits.... ::) everywhere it says to look has NO definition by law of the tidal limits in any waterway.... :Hunting)

So to be safe, fish above the first weir you come to if you really have to go Bass fishing.

The previous can of worms has been replaced with another can of worms as DAF are adverse to giving definitive boundarys in writing.
The South Pine is another area where the mangrove rule does not work and the water above the Stanmore road crossing on the Albert are tidal.
As Andrew states it is really up to the ethics of the individual where they fish.
The new rules have certainly opened up a lot of new waters but could have been more specific as the main area of contention was the Brisbane river.
Cheers
Ray

It's pretty simple.  If the water flows only downstream it's OK.  If the water flows in and out with the tide its not OK.  Some people could make a ham sandwich look confusing.

And I might add after thinking about it today, its about the only river that could be still wild, there are no weirs in the regions where it is still tidal...it could be the states last wild river,,

There's a barrier for them to try and get over at Berrys Lagoon in Churchill, Sel.
