Border report - DELIVERANCE

A few of us went down to fish the NSW / Qld border waters.

Water at Texas too dirty so we made the call to move upstream looking for clearer waters.

Ended up at a crossing on the upper Dumaresq River for the night, which was damn cold by the way.

Next morning drove to another road to launch....we noted a new sign on the gate saying "PRIVATE PROPERTY - KEEP OUT". As this IS a public road we ingnored the signs and we down to launch, closing the gate behind us. Within minutes we had a local chase us down there tell us we were trespassing & to get out. After a discussion on boundaries and telling the local they probably should call police if they had an issue she backed down (the intimidation didn't work) and told us it was ok to launch there and we were welcome to call up to the house to let them know if we were going there in future. After that she tore off across the river crossing almost getting her car stuck & swamped. While I was pulling gear out to get the snatch strap out she managed to free herself and went up to the property on the NSW side of the river, the road on the NSW side is a TSR by the way. 
We launched and went upstream towards the a creek junction.

After paddling / walking the kayaks up a couple of shallow sections on the creek we were pulled up by a bloke on a motorbike yelling & swearing at us from further downstream. Paddled back to talk to the guy who wouldn't even give his name or identify himself. He was adamant that by being on the water we were tresspassing & apparently we'd told the woman earlier to f off. (It's obvious now where she was heading across river in a hurry) Said he owns the land and the creek and also has a lease on the TSR. He then inclined that they were hunting on the propertry and that we might end up with a bullet....take that threat any way you want, we will find out what the authorities think of it this week.

He also told us all about this research program on the cod in the area after telling him I've been attending it since the start he realised I knew more about it than him he changed the subject and started talking guns again (more intimidation). Has anyone ever heard of a 300 Magnum? New to me but apparently we were in danger of being shot by one.....  :Hunting)

Realising he had us at a distinct advantage, we asked if we could have his "permission" to stay on the creek, he demanded we immediately get off his creek altogether, again mentioning the threat of getting shot.

We left, packed up and came home, you never know where or when those "stray bullets" might end up...

That sux Garry, it is a shame that some people feel that way, however he has probably had to deal with a lot of people who do not do the right thing.

I can't share any more info relating to this matter as it is now under investigation by the relvant authorities. However I can pass on from relevant authorities I spoke to that if you are in a similar situation in NSW waterways, you are NOT acting illegally and cannot be threatened, intimidated or forced to leave.....  As long as you access the waterway lawfully and don't leave the beds and banks of the waterway you are not acting illegally, trespassing etc

Time we all invested in gopro cameras. Just turn it on when confronted. They'll end up shooting themselves in the foot first.

Agreed Andrew, 

I have no doubt that the aggressor has had some run ins with people in the past, but that doesn't justify his incorrect assumptions  about us, nor his actions. Also i bet he hasn't dealt with anyone like me before either in that I occasionally follow up on things like this, and in this instance already have and will continue to do so.

A real shame from all angles that these things happen and can't be quickly resolved. Imagine if he did that to the type of person who might have acted a bit differently or decided to ( as he did) to take the law into their own hands??

A 300magnum is not the sort of thing most hunters over there would not need, It's massive overkill for goats, deer and pigs. There are a few variations of that calibre. It sounds to me like he was going for the full monty as far as intimidation is concerned. MY dealings with most landholders over there have been good, but there's always the exception. Be interested in hearing the outcome. May have been worried about you finding his droppers.

Absolutely, however we weren't in his yard hunting toads. We were on a public water course owned by the state of NSW, not on his property & most certainly not in his yard. There's a difference....

Well no dramas , just checking . I know some people get annoyed just being insight of there back fence.. My best advice , steal their letter box, when they get a new one put the old one beside it
