Fishing rights in a canoe
« on: March 14, 2014, 07:55:07 PM »
Hello All
Can anyone tell me if i am doing anything wrong by the following,
Fishing at the Condamine river at Tummavulle upstream from Yarramolong Weir, on my last venture there i launched my canoe at the Tummavulle bridge which is public property working my way down stream flicking lures having a good time next thing i had some arsehole abusing me telling me to &*#@ off his property, after listening to his abuse i told him that i was not doing anything wrong as i gained access to the river on public land and that he does not own the river or fish and carried on fishing then he threatened to stop me with a double barrel shotgun that was his exact words, this happened about 6weeks ago,
So tonight i called him and advised him of my intentions to go fishing there again tomorrow thinking this would be the right way to go only to cop another barrage of abuse and saying to fish else where, should i report this w@nker.    Sorry if this is a bit long winded.....
Cheers Pearcey :Hunting)

If he has threatened to shoot you, the police are the people you need to speak to.  But you should have done it as soon as it happened the first time.

You're allowed to be on the water, but not on the riverbanks along the edge. The beds and banks of the river are his land but is crown land, however an adjoining land ownder can presume the river bank next to his property are his & grant/deny access as desired.

So if you're floating along in a canoe & you access the water from a crossing / reserve etc you're doing nothing wrong.

Producing a gun and threatened to use one breaks state & federal laws. Even the mention of a gun you should call 000 imediately!!!

Why wouldn't you call the cops? Trespassing or not, you should have first up.
