I have also posted this on Ausfish and other forums but think that it is of sufficient importance topost here as well.
I got the info from a newsletter from the Downrigger shop.
  There is currently a seller on ebay selling gill nets and fish traps that are illegal for a private person to have in their possession in all states.
The seller is in qld and looking at his feedback he has already sold over 500 of them.
 Apparently it is quite legal to sell them.
 Ebay are not interested.
 Here is the response from the seller.

"Hi, I understand your idea.
The most used weapon for killing people is kitchen knives.
Why not ban the sale of knives? Or axes? Or cars? etc.
If you can use internet - can understand the law and be responsible.

There is another way to tackle it if we are interested as individuals.

Fisheries recently sent me the HOTLINE number for FISHWATCH, if you see anything illegal report it.

Phone 1800017116 and report it.  We all carry our mobiles these days.

Produce stores out west used to sell them as anti bird netting for fruit trees. In 3m drop 50m long.........

Pretty blatant if he is advertising them as gill nets. Fisheries could just go to court for his list  of buyers and have a few easy prosecutions.

Most tobacco shops sell crack pipes and water pipes, I'm sure they only get used for champion ruby as well ;)

I have also noted that haverfords a long established australian net supplier has gill nets for sale to the public and they do not have a warning on their website to check your local regulations before purchase.

One of the great contradictions in the law. In NSW you can buy cast nets but you can't use them in the state. I wonder why I can't buy a 357magnum and just not use it???

Simple there shat !  :P

It does seem extremely two faced all this tho. i know you can buy orchard netting out near stan....p much the same stuff . we use it for protecting small patches of corn we grow for ourselfs, I would follow suite with Jim Tait and burn them if i found any in use

Yep....Can't stop them selling as orchard nets.....can't stop them possessing them .... as long as they have 'reasonable excuse'.....I would suggest 'orchard net' would be considered reasonable as long as person had trees and the net had float line removed.....It is a bit like the targetting Barramundi in Closed Season law...."Uhmmm, sorry Mister Fisheries Officer, I am targetting Jack or Salmon but all i can catch are these damn barra".... "Oh thanks sir, continue fishing".....

This issue was recently (late last year) bought up by the commercial fishing industry and plonked on the Fisheries Managing Directors desk for her thoughts. The commercial guys are suggesting that the Fisheries Act change to make it unlawfully to purchase a commercial dimensioned net unless you hold commercial fishing licenses for that net - my thoughts are that QBFP have enough on their plate and to include another investigation on another establishment (i.e. net-makers) which they would not normally interact with - is just a further spread of the thin resources they have available

To my mind the main impost would be on the net retailers having to check on the veracity of the license number supplied by the purchaser with very little policing required by Deedi.
 I am just very concerned what the long term impact on out streams and fisheries will be by the proliferation of cheap gill nets being freely available .
In the sweetwater rivers we are currently enjoying the best fishing for years due to the overflow events of out stocked dams associated with the dispersment of the escapee fish forming a  breeding nucleus in waters where these fish have not been seen for a very long time.
How long will this last with a few gill nets strung across the rivers?
Is it not more cost effective to stop the problem at the source than to ignore it by stating that we do not have the resources and then subsequently  have major problems with a decimated fishery.
 At least the pros had the foresight to at least have a go.
 Here is an instance where both the pro and recreational sectors should be speaking with an united voice.

Was in Big W at Morayfield yesterday, they still have dillies on the rack in the fishing section. More than likely just old stock, but they should be on to that sort of thing. Gunna write to them.

He lives on the sunshine coast. Guess where the net was set?
